SESSION AND BOOKING FEES
Sessions dates are secured by payment of a $50 booking deposit.
Your shoot date is not reserved until your booking deposit has been paid.
The payment of the full session fee is due at the latest 48 hours before your shoot date.
This amount will be included in your invoice (less booking deposit) which will be sent once session details have been confirmed by the photographer.
Session location and dates are subject to photographer and studio availability.
CANCELLATIONS AND RESCHEDULING
Cancellations made more than 7 days prior to your session will receive a full refund of any payments made.
Cancellations made less than 7 days prior to your scheduled session, will forfeit the booking deposit.
If Beyond the Lens Creative cancels the session, we will provide you with a full refund of any payments made.
Rescheduling requests within reason, are permitted without penalty. We do ask that sufficient notice is given (24 hours) if you do need to reschedule.
If the weather is not suitable for your location session, we will reschedule for a new date.
RE-SHOOTS
Re-shoots are at the discretion of the Beyond the Lens Creative.
CLIENT CAMERA/PHONE CAMERA USAGE
To avoid disruption to the photographic coverage and to allow your Photographer to capture beautiful images of your family, photography, videography etc by family/friends during the shoot is not permitted.
PRICING AND PRODUCTS
We happily provide all clients with a pricing guide upfront. You agree that you have received, read and understand the Studio’s price list.
DELIVERY OF IMAGES
Final edited images will be provided within 14 days. Turn around times may vary during peak periods.
Raw/unedited images are not provided.
DIGITAL FILE STORAGE
Once supplied via our online gallery, we guarantee access and security of your files for 12 months. Beyond this time, storage, and maintenance of your digital images is your responsibility. MAKE SURE YOU BACK UP YOUR DIGITAL FILES.
PAYMENT
Full payment is due by the specified date on your invoice and 48 hours prior to your session date. Payment can be made via Paypal or Direct Deposit / PayID.
COPYRIGHT
Beyond the Lens Creative retains the copyright of all images. Printing, copying, downloading, screenshots or scanning images without written consent is prohibited by Australian copyright law.
Digital files, when purchased, will be supplied with unlimited reprinting rights for personal use only. This might include, but is not limited to, printing, copying or emailing.
Images may not be used for commercial or editorial purposes or entered into contests without the express permission of Beyond the Lens Creative, who retains all copyright as per Australian Copyright Law.
Original RAW files and digital files remain the property of Beyond the Lens Creative.
Unless otherwise indicated on your agreement or in writing, it is agreed that the Studio may use any image from your session for industry competitions and as required for reasonable general promotional material for the Studio.
*Business clients are granted a non-exclusive, non-transferable licence to use images for commercial purposes including marketing, advertising, social media, websites and promotional materials. Images may not be sold or used in a misleading or unlawful manner.
RETURN POLICY
Australian Consumer Law (ACL) Nothing in these Terms limits your rights under Australian Consumer Law (ACL).
Due to the creative nature of photography services, change of mind refunds are not provided once a session has been completed. Refunds will not be granted based on dissatisfaction with artistic style, editing choices or subjective preferences. If a technical failure or error attributable to the photographer prevents delivery of usable images, liability is limited to re-shooting the session or refunding the amounts paid, at Beyond the Lens Creative’s discretion.
CLIENT RESPONSIBILITIES
Clients are responsible for arriving on time. For family & pet sessions, the photographer is not responsible for the behavior and safety of children and animals.
PRIVACY POLICY
We respect your privacy and are committed to protecting your personal information.
Information collected: Name, email address, phone number, billing and payment information, session details and preferences.
Use of Information: To provide and manage photography services, communicate regarding bookings and deliverables and to send invoices/receipts.
Data Protection: Personal details are stored securely and not shared with third parties except as required for payment processing or by law. Images are archived for 12 months and then at the photographers discretion.
LIMITATION OF LIABILITY
We are not liable for loss, damage or injury during sessions. We are not liable for failure to perform due to circumstances beyond our control, including but not limited to natural disasters, illness, government restrictions or equipment failure.
GOVERNING LAW
These terms are governed by and construed in accordance with the laws of Western Australia.
AMENDMENTS
We reserve the right to update these Terms at any time. The latest version will be made available on request or via our website.
